Burnout syndrome and obesity are two growing conditions that affect employees’ health and company productivity. Recently, several studies have pointed to a possible relationship between both phenomena. However, such a relationship has not been clearly defined. This research analyzes the relationship between BS dimensions and body mass index, the latter being treated as a moderator variable among obese senior and middle managers in the Mexican maquiladora industry through a structural equation model. A total of 361 senior and middle managers completed (...) both the Maslach Burnout Inventory-General Survey [with emotional exhaustion, cynicism, and professional efficacy as subscale dimensions] and a sociodemographic questionnaire. The results showed a statistically significant relationship between EE and PE, with BMI acting as a moderator variable. The results showed that when BMI increases as a moderator variable, the strength of the relationship between EE and PE also changes. For example, although PE had a negative value of 0.14 before the moderator effect, the value increased up to 0.32 when the BMI was factored into the relationship. Therefore, maquiladora industries are being advised to increase their investments on the identification and prevention of employees’ EE and obesity. Such interventions would promote a better quality of life and could prevent economic losses resulting from poor employee performance. (shrink)

The informed consent is an ethical and legal requirement for potential participants to enroll in a study. There is ample of evidence that understanding consent information and enrollment is challenging for participants in clinical trials. On the other hand, the reasoning process behind decision-making in HIV clinical trials remains mostly unexplored. This study aims to examine the decision-making process of people living with HIV currently participating in antiretroviral clinical trials and their understanding of informed consent. We conducted a qualitative socio-constructivist (...) study using semi-structured interviews. Eleven participants were selected by purposive sampling in Argentina until data saturation was reached. A content analysis was performed. The findings highlight the fact that some participants decided to enroll on the spot, while others made the decision a few days later. In all cases, the decision was based on different aspects of trust (in doctors, in the clinical research site, in the clinical trials system) but also on emotions associated with HIV and/or treatment. Moreover, while people living with HIV felt truly informed after the consent dialogue with a researcher, consent forms were unintelligible and unfriendly. The immediacy of patient decision-making has rarely been described before. Enrollment in an HIV clinical trial is mainly a trust-based decision but this does not contradict the ethical values of autonomy, voluntariness, non-manipulation, and non‐exploitation. Thus, trust is a key issue to be included in reshaping professional practices to ensure the integrity of the informed consent process. (shrink)

This paper presents a novel framework for evaluating racial profiling, including 'rational profiling' that does in fact decrease crime rates. It argues that while profiling some groups, such as African Americans and Muslims, is impermissible, profiling others, such as white men, may be permissible. The historical and sociological context matters significantly. Along the way, the paper develops a new theory of what expressive harms are, why they matter, and when it is the responsibility of the state to correct them.

The COVID-19 pandemic has triggered panic-buying behavior around the globe. As a result, many essential supplies were consistently out-of-stock at common point-of-sale locations. Even though most retailers were aware of this problem, they were caught off guard and are still lacking the technical capabilities to address this issue. The primary objective of this paper is to develop a framework that can systematically alleviate this issue by leveraging AI models and techniques. We exploit both internal and external data sources and show (...) that using external data enhances the predictability and interpretability of our model. Our data-driven framework can help retailers detect demand anomalies as they occur, allowing them to react strategically. We collaborate with a large retailer and apply our models to three categories of products using a dataset with more than 15 million observations. We first show that our proposed anomaly detection model can successfully detect anomalies related to panic buying. We then present a prescriptive analytics simulation tool that can help retailers improve essential product distribution in uncertain times. Using data from the March 2020 panic-buying wave, we show that our prescriptive tool can help retailers increase access to essential products by 56.74%. (shrink)

Laexperiencia curativa desde el filosofar transforma al ser humano y lo prepara para enfrentarlas grandes problemáticas de su quehacer cotidiano. La metodología utilizada fue de enfoquedescriptivo en la que las fuentes permitieron acercarse a la argumentación dialógica del filosofar.La experiencia íntima de la filosofía se da gracias al diálogo filosófico que, más que método, es unaexperiencia que posibilita la relación conmigo mismo, con los otros y con las cosas a través de lapalabra, la razón y la sensación que surge en el devenir mismo del diálogo; esto es lo que lleva aentender el diálogo como una experiencia que cura y transforma. Por medio del diálogo filosófico,se logra un autoconocimiento que tiene el poder de curar, sanar, reparar y transformar a la personahumana, al “hombre de carne y hueso”. (shrink)

Organized youth sport has become a prominent activity in Western societies, one around which myriad families structure their daily lives. Despite its popularity, or rather because of it, youth sport is besotted with complex problems. One distinctive set of problems pertains to children’s opportunities to benefit from engagement in sport. Such problems require a reflection on the conditions of justice. The goal of this paper is to explore ethical guidelines to make youth sport more just. The paper begins by characterizing (...) childhood, youth, and youth sport. Then, it articulates considerations of justice in youth sport. Together, these sections provide a basis to formulate the general features of a just youth sport. What emerges is a vision of youth sport that the adults involved in it should emphasize and implement if their young charges, and youth sport, are to flourish, as well as a novel approach to formulating and justifying normative criteria to make youth sport more just. This paper is an attempt to connect the Brazilian Paulo Freire’s well known educational thinking with the “philosophy for children” movement. It considers the relationship between the creator of philosophy for children, Matthew Lipman and Freire through different attempts to establish a relationship between these two educators. The paper shows that the relationship between them is not as close as many supporters of P4C have claimed, especially in Latin America. It also considers the context of Educational Policies in our time (...) and why Freire’s understanding of the politics of education makes it impossible to be Freirean and at the same time be neutral or favorable to the actual status quo. Finally, after presenting Lipman’s understanding of the relationship between philosophy, education and democracy and their connection to capitalism, it proposes ways to begin the political path of philosophizing with children inspired by Paulo Freire’s educational thinking. As a result, a more politically committed path to doing philosophy with children is offered. (shrink)

I defend impact-based accounts of institutional racism against the criticism that they are over-inclusive. If having a negative impact on non-whites suffices to make an institution racist, too many institutions (including institutions whose affirmative action policies inadvertently harm its intended beneficiaries) would count as racist. To address this challenge, I consider a further necessary condition for these institutions to count as racist—they must stand in a particular relation to racist ideology. I argue that, on the impact-based model, institutions are racist (...) if they have a negative racial impact AND this impact is legitimized by racist ideology. Racist ideologies limit social criticism of and collective action against institutions that have a negative racial impact, and in so doing, lend stability to systems of racial domination. (shrink)

This paper argues that racism should not only be conceived as a moral concept whose main aim is to condemn severe wrongs in the domain of race. The paper advances a complementary interpretation of racism as an explanatory concept--one that plays a key role in explaining race-based social problems afflicting members of subordinate racialized groups. As an explanatory concept, the term 'racism' is used to diagnose and highlight the causes of race-related social problems. The project of diagnosing race-based social problems (...) contributes to the pragmatic anti-racist end of developing better political and policy strategies for solving these social problems. The paper defends this interpretation of racism as an explanatory concept through a critical engagement with Urquidez's moral-philosophical account of racism. (shrink)

O filósofo sustenta que na cultura moderna há um uso desmedido da história, o que constitui um vício que legitima as pseudo-culturas. A educação é, por excelência, o meio propagador da cultura e, segundo Nietzsche, a educação moderna reproduz e legitima um tipo de saber superficial e especializado, que é (...) contrário à vida. No presente artigo elucida-se o conceito de cultura nietzschiano, a fim de compreender as linhas gerais dos apontamentos do filósofo acerca da relação entre história, cultura e educação na modernidade. The capability approach is gaining momentum as a theory of corporate responsibility and business ethics at a time when the UN Guiding Principles have become a most important framework. A novel approach is now emerging that seeks to understand and specify human rights obligations of businesses within the framework provided by the capability approach. This article partially examines the triad corporate responsibility–human rights–capability approach by exploring the relationship between human rights and capabilities. Thus, it offers conceptual and practical implications for (...) a human rights perspective on corporate responsibility. The bulk of our thesis focuses on studying Nussbaum’s and Sen’s claim that human rights are entitlements to capabilities by means of a discussion of the notion of human dignity. In particular, we show the capability approach’s ability to dissipate theoretical and practical challenges posed by the notion of dignity. This article does not offer a detailed explanation of the implications of our investigation for human rights responsibilities of business. However, an outline of its potential contribution toward unfolding those obligations, conceptually and practically, is provided. (shrink)

In 1939, the influential psychophysicist S. S. Stevens proposed definitional distinctions between the terms ‘number,’ ‘numerosity,’ and ‘numerousness.’ Although the definitions he proposed were adopted by syeveral psychophysicists and experimental psychologists in the 1940s and 1950s, they were almost forgotten in the subsequent decades, making room for what has been described as a “terminological chaos” in the field of numerical cognition. In this paper, I review Stevens’s distinctions to help bring order to this alleged chaos and to shed light on (...) two closely related questions: whether it is adequate to speak of a number sense and how philosophers can make sense of the claim by cognitive scientists that numbers are perceptual entities. Moreover, I offer further support to Stevens’s distinction between numerosity and numerousness by showing that they are relational properties that emerge through different relationships between agents and their environments. The final conclusion is that, by adopting Stevens’s distinctions, numbers do not need to be seen as perceptual entities, since the so-called number sense is better described as a sense of numerousness. Many liberal democracies have large populations of “unauthorized” migrants, who entered in contravention of immigration laws. In this paper, I will offer a new argument for allowing long-resident unauthorized migrants to transfer to “legal” status, which would allow them to live and work legally in their country of residence, without fear of deportation. I argue that legalization is required to secure the autonomy of these migrants, and that only by securing their autonomy can the state exercise authority over them legitimately. (...) The doing/allowing distinction plays an important role in our thinking about a number of legal issues, such as the need for criminal process protections, prohibitions on torture, the permissibility of the death penalty and so on. These are areas where, at least initially, there seem to be distinctions between harms that the state inflicts and harms that it merely allows. In this paper I will argue for the importance of the doing/allowing distinction as applied to state action. Sunstein, Holmes, Vermeule (...) and others have presented influential arguments for the claim that where the state is concerned the doing/allowing distinction has no moral significance, even if it does elsewhere. I show that these arguments can be resisted. In doing so, I defend some important distinctions and principles that help us understand the state’s role in protecting people from harm. (shrink)

The field of numerical cognition provides a fairly clear picture of the processes through which we learn basic arithmetical facts. This scientific picture, however, is rarely taken as providing a response to a much‐debated philosophical question, namely, the question of how we obtain number knowledge, since numbers are usually thought to be abstract entities located outside of space and time. In this paper, I take the scientific evidence on how we learn arithmetic as providing a response to the philosophical question (...) of how we obtain number knowledge. I reject the view that numbers are abstract entities located outside of space and time and, alternatively, derive from the scientific evidence a novel account of the nature of numbers. In this account, numbers are reifications of the counting procedure and arithmetic statements are seen as describing the functioning of counting and calculation techniques. (shrink)

In this paper some classical representational ideas of Hertz and Duhem are used to show how the dichotomy between representation and intervention can be overcome. More precisely, scientific theories are reconstructed as complex networks of intervening representations (or representational interventions). The formal apparatus developed is applied to elucidate various theoretical and practical aspects of the in vivo/in vitro problem of biochemistry. This study investigates the impact of internal corporate governance on the relation between disclosure quality and earnings management in the UK listed companies, in particular whether governance mechanisms have deterrent effect on earnings management similar to firms’ disclosure quality. Unlike prior literature, we measure a number of board and audit committee-related governance instruments, three disclosure quality proxies and the Modified Jones Model to test the hypotheses of the study on a matched-pair sample data of Investor Relation Magazine Award winning and (...) non-winning firms. Our findings in the OLS and sensitivity analyses using Heckman Procedure and 2SLS regressions consistently report a significant negative association between earnings management and disclosure quality for all proxies in restraining earnings management. In contrast, corporate governance variables are mostly insignificantly related to earnings management. This provides an emerging trend of the outperformance of disclosure quality over internal governance mechanisms in lessening earnings management. These findings warrant due attention of the policy makers, investors, corporate firms and other stakeholders in shaping a high-quality disclosure and governance regime in corporate settings to mitigate managerial manipulations of earnings across the countries in the world. The aim of this paper is to critically examine David Shaw, Wybo Dondorp, and Guido de Wert’s arguments in favour of the procurement of human organs from human/nonhuman-primate chimeras, specifically from great-ape/human chimeras. My main claim is that their arguments fail and are in need of substantial revision. To prove this I first introduce the topic, and then reconstruct Shaw et al.’s position and arguments. Next, I show that Shaw et al.: (1) failed to properly apply the subsidiarity and proportionality (...) principles; (2) neglected species overlapping cases in their ethical assessment; (3) ignored the ethics literature on borderline persons; and (4) misunderstood McMahan’s two-tiered moral theory. These mistakes render an important part of their conclusions either false or problematic to the point that they would no longer endorse them. Finally I will briefly mention a possible multipolar solution to the human organ shortage problem that would reduce the need for chimeras’ organs. (shrink)

La présente contribution analyse les deux risques auxquels sont confrontés l’administration pénitentiaire et son personnel, les surveillants notamment, dans leur lutte contre la radicalisation : le risque de la protection insuffisante de la société face à des conversions non repérées et susceptibles d’aboutir à des actes violents de type terroriste, d’une part, et, d’autre part, le risque du signalement systématique pouvant conduire au renforcement du sentiment de discrimination chez certains détenus et, paradoxalement, constituer un terrain favorable au développement de la (...) radicalisation violente. Pour dépasser ces deux risques, il est proposé, à partir de données de terrain, une application équilibrée du principe de précaution qui devrait reposer sur une meilleure formation des personnels par la pratique, entre autres, de l’interprétation croisée. Set of articles, fruits of research by anthropologists, focused on the health area. First work of its kind in the country, which deepens mental health issues, cosmological view of specific groups, relationships between body, mind and culture and healing issues seen from the perspective of various popular religions. The work contrasts with the efforts of health scholars to approach anthropological approaches, so that it becomes an instrument for understanding the health / disease phenomenon and its complex articulation processes.

Esa rareza que llamamos conciencia, lo más misterioso que hay en el universo, procedería de darse en ella la conjunción de dos cosas totalmente distintas: por un lado, el acto de referirse a algo y ese algo a lo cual se refiere. A esta forma de relación es a lo que tradicionalmente se ha denominado “intencionalidad” de la conciencia.

No presente artigo pretendo apontar, primeiramente, a relação entre diagnóstico do presente e atitude crítica a partir do pensamento de Michel Foucault. Na sequência, indicarei que a noção de atitude crítica é ao mesmo tempo parceira e adversária da governamentalidade, no sentido de que ela designa uma arte plural de não ser governado de determinada maneira e pelos mesmos agentes, sem, contudo, se posicionar fora do jogo governamental. Mostrarei ainda que as lutas políticas contra a saturação do jogo governamental podem (...) ser pensadas como um desdobramento da atitude crítica. Finalmente, procurarei demonstrar que a tentativa cotidiana de viver e refletir democraticamente diante de um exercício autoritário do poder, como se pôde vislumbrar especialmente nos últimos anos no Brasil, pode ser entendida como um gesto de ressignificação da atitude crítica. A problematização deste campo de análise não foi diretamente tratada por Foucault, mas tem se tornado um objeto de estudo irrenunciável para o diagnóstico político de nosso presente. (shrink)

Blumenberg´s “metaphorology” is offered as a hermeneutical alternative to the Heideggerian existential hermeneutic. This implies that philosophical anthropology —as we find it in Gehlen, Plessner and others— achieves onthological standing, and is developed as a history of great metaphors, which supports the history of ideas.

No curso La société punitive, Michel Foucault indica até que ponto as lutas em torno do poder político produzem efeitos de realidade. Um deles é o nascimento de um novo sistema de penalidade no começo do século XIX. Ele surge de uma reconfiguração das lutas políticas em relação ao século XVIII. O conceito explicativo que fundamenta essa reconfiguração é o de ilegalismo, retomado mais tarde em Vigiar e punir. No século XVIII, ele designa um conjunto de transgressões de ordem política (...) que são toleradas e praticadas por diferentes agentes sociais, dentre eles a burguesia; no decorrer do século XIX, as lutas e resistências das camadas populares e trabalhadores contra o sistema político vigente deixam de ser toleradas e são tipificadas como infração à ordem estabelecida pela nascente penalidade burguesa. A transformação dos ilegalismos em ilegalidades é coetânea à elaboração de táticas de inserção da moral punitiva no interior do sistema penal. No artigo, percorremos a mudança estatuto das lutas políticas em torno do poder e em que sentido a nova penalidade não deixa de ser a continuidade da guerra social por outros meios. Enfatizamos, enfim, a importância do conceito de guerra civil introduzido nesse curso, tanto para a elaboração teórica da analítica do poder quanto pelo seu cruzamento com as lutas do presente em torno das práticas judiciárias. La sociología del derecho estudia las relaciones derecho, sociedad, en esa medida una de sus líneas de investigación es la que estudia la relación valores jurídicos, derecho y sociedad. La Constitución que entró en vigencia en 1991, encontró su fuente de inspiración en la igualdad y la libertad como valores jurídico-políticos para alcanzar la justicia, de ahí, que en materia de participación política traiga el concepto de democracia participativa dentro de su normatividad. Sin embargo, la realidad social colombiana, sobre todo (...) en materia de participación política, está muy lejos de ser una aproximación a los ideales redactados en el texto constitucional. La democracia representativa sigue siendo la regla general; ahora bien, existen algunos avances en ciertos aspectos producto del debate permanente sobre los contenidos de la Carta, y en concordancia con el concepto de democracia participativa, los cuales, producen reformas que se realizan mediante actos legislativos, que es el mecanismo que trae la propia Constitución para ser reformada; también mediante este mismo medio, se han dado pasos en contravía del espíritu inicial de la Carta Constitucional de 1991. Las fronteras entre la poesía y la filosofía fueron abiertas desde la misma antigüedad; sin embargo, el esfuerzo de los filósofos racionalistas por cerrarlas jamás fructificó; por el contrario, la imaginación moderna tejió las diferencias y afinó un debate que hoy parece llegar lento pero estremecido a su final. Este texto trata de esa querella, de cómo se planteó históricamente y de cómo la verdad y el conocimiento encuentran sentido en la fusión creativa antes que en la exclusión lógica.
